Terms of Service

Buoykeeper reads your email and organizes it into cases, with summaries, actions and dates, so you can see where things stand. It connects to your Gmail account through Google’s sign-in and uses AI from Google and Anthropic to process your email, as described in the Privacy Policy. Buoykeeper is an organizing tool. It is not a substitute for legal, financial, tax or other professional advice.

You must be at least 18 and live in the United States to use Buoykeeper. You must give accurate information, keep your Google account secure, and tell us at support@thecontrolsurface.com if you think your account has been compromised. You are responsible for activity under your account.

• You may connect only an email account you own or are authorized to use for this purpose.
• You authorize Buoykeeper to read your mail through Gmail’s read-only permission, solely to provide the Service. Buoykeeper cannot send, delete or change your email.
• You can remove Buoykeeper’s access at any time on Google’s permissions page, or delete your account in Settings.

Buoykeeper is in beta. By using it you understand and agree that:

• The Service is free during the beta. It may change, lose features or stop, with or without notice.
• It may have bugs, including wrong or missing cases, and it may be unavailable at times.
• Troubleshooting access. To diagnose problems and improve Buoykeeper, our team may look at your cases, your email details (such as subjects, senders and dates) and the AI’s output for your account. We do this only while working on a problem, and we do not share what we see. This is the beta access described in section 5 of the Privacy Policy.
• We may contact you by email to ask about your experience.

Buoykeeper is free during the beta. If we introduce paid plans, we will tell you in advance, and we will not charge you unless you choose a paid plan.

Please read this carefully. Buoykeeper uses AI to read unstructured email and attachments. AI is probabilistic and makes mistakes.

• We do not guarantee that any summary, action, date, amount, name or other detail Buoykeeper produces is accurate or complete.
• How emails are grouped into cases is a judgment the AI makes, and may not match how you would group them. Buoykeeper may also miss emails that matter to you.
• Buoykeeper may not be able to read some attachments accurately, for example scanned or protected documents.
• You are responsible for checking anything important against the original email before you rely on it, including before you pay, sign, reply to a deadline or take legal action.

You release The Control Surface LLC from liability for losses that result from relying on Buoykeeper’s output without checking it.

You agree not to:

• use the Service for anything unlawful;
• reverse engineer, decompile or disassemble the Service;
• interfere with or disrupt the Service or its servers;
• access the Service with bots or scrapers, or get around its access limits;
• resell or redistribute the Service without our written permission; or
• use the Service to process email you are not authorized to access.

We may limit or suspend an account that uses a disproportionate share of resources (such as AI processing), and we will try to tell you first unless the use is abusive or harming the Service.

Your content. Your email, and the information Buoykeeper produces from it for you, remain yours.

Our service. Buoykeeper’s software, design and branding belong to The Control Surface LLC. You may not copy or modify them without our written permission.

Feedback. If you send us suggestions or feedback, we may use them for any purpose without paying you.

Buoykeeper depends on services run by others, including Google (Gmail and Gemini), Anthropic, Supabase, Vercel and Inngest. Your use of Gmail is also governed by Google’s terms. We are not responsible for the availability or conduct of these services. If one of them changes or stops, we may have to change or stop parts of Buoykeeper.

The Service is provided “as is” and “as available”, without warranties of any kind, express or implied, including merchantability, fitness for a particular purpose, non-infringement and accuracy.

We do not promise that the Service will meet your needs, be uninterrupted, timely, secure or error-free, or that errors will be fixed. There is no service-level agreement and no guaranteed uptime. Some places do not allow these exclusions, so some may not apply to you.

To the fullest extent the law allows, The Control Surface LLC and its officers, employees and agents are not liable for any indirect, incidental, special, consequential or punitive damages, including lost profits, revenue, data or opportunities, business interruption, or damages from relying on AI output or from the failure of a third-party service.

Our total liability for all claims relating to the Service is limited to the greater of the amount you paid us in the 12 months before the claim, or one hundred US dollars ($100).

These limits apply whatever the legal theory, and even if we were told such damages were possible.

You agree to indemnify and hold harmless The Control Surface LLC and its officers, employees and agents from claims, losses and costs (including reasonable legal fees) arising from your use of the Service, your breach of these Terms, your breach of any law or of anyone else’s rights, or decisions you make based on the Service’s output.

By you. You can stop at any time by deleting your account in Settings. Your data is then deleted as described in the Privacy Policy.

By us. We may suspend or close your account if we reasonably believe you have broken these Terms or put the Service or other members at risk, or if we end the beta or the Service. Where we can, we will tell you first.

Sections that by their nature should continue after termination (including 6, 10, 11, 12 and 14) continue.

Talk to us first. Before starting a formal dispute, you agree to email us at support@thecontrolsurface.com and try to resolve it informally for at least 30 days.

Binding arbitration. If that fails, any dispute relating to these Terms or the Service will be resolved by binding arbitration administered by the American Arbitration Association under its Consumer Arbitration Rules, in English. Judgment on the award may be entered in any court with jurisdiction.

Class action waiver: disputes will be resolved only on an individual basis, not in a class, consolidated or representative action.

Small claims. Either of us may bring an individual claim in small claims court if it qualifies.

Opting out. You may opt out of arbitration by emailing support@thecontrolsurface.com within 30 days of first accepting these Terms, with your name, your email address and a clear statement that you opt out.

Governing law. These Terms are governed by the laws of the State of Texas, without regard to its conflict-of-law rules. For any dispute not subject to arbitration, you consent to the exclusive jurisdiction of the state and federal courts in Harris County, Texas.

• Changes to the Service. We may change, suspend or discontinue the Service or any part of it.
• Things outside our control. We are not liable for failures caused by events beyond our reasonable control, including outages at the providers listed in section 9.
• Entire agreement. These Terms and the Privacy Policy are the whole agreement between you and us about the Service.
• Severability and waiver. If part of these Terms is unenforceable, the rest still applies. Not enforcing a right is not a waiver of it.
• Assignment. You may not transfer these Terms without our written consent. We may transfer them.
• Notices. We may send notices by email or in the app. You can reach us at support@thecontrolsurface.com.

We may update these Terms. For material changes we will tell you by email or in the app at least 30 days before they take effect. If you keep using Buoykeeper after that, you accept the new Terms; if you do not agree, stop using Buoykeeper and delete your account.
